Mandatory Risk Warning and Consent to Participate
Diabetes Australia provides the following risk warning pursuant to its obligations under the Civil Liability Act, 2002 (Tas):
RECREATIONAL ACTIVITIES ARE DANGEROUS AND INVOLVE A SIGNIFICANT RISK OF PHYSICAL HARM OR PERSONAL INJURY INCLUDING PERMANENT DISABILITY AND/
OR DEATH TO PARTICIPANTS. ANY SUCH INJURY MAY RESULT NOT ONLY FROM YOUR ACTIONS BUT FROM THE ACTION, OMISSION OR NEGLIGENCE OF OTHERS.
I, being the participant, have read and agree to these terms and conditions.
- PolliePedal’26 may be cancelled at Diabetes Australia’s discretion.
- I participate in the PolliePedal’25 at my own risk. I will take all reasonable measures to protect myself from the risks of participation.
- I am responsible for all property I use during the PolliePedal’26 and that Diabetes Australia accepts no responsibility for any loss or damage to such property.
- I will comply with national, and state public health orders as dictated by the relevant local, state and federal government policies, and under accepted COVID safe guidelines.
- To the best of my knowledge, I am not suffering from any condition that would prevent and/or render me unfit to participate in the PolliePedal’26
- I acknowledge that I am responsible for my own health and safety at all relevant times before, during and after participation in PolliePedal’26 and I agree to take all reasonable precautions to protect myself Including that any cycling equipment and personal protective clothing complies with my latest personal health advice, is in good working order and fit for purpose.
- I understand that Diabetes Australia recommends that I inform a support person of my intention to participate and the details of the PolliePedal’26 route, and that I carry a mobile phone or watch.
- I will comply with all reasonable directions and decisions of the officials, and other representatives of Diabetes Australia.
- I acknowledge and agree that subject at all times to these terms and conditions Diabetes Australia and its Related Bodies Corporate as defined in the Corporations Act (‘Diabetes Australia Group’), and their directors, officers, employees, volunteers, contractors or agents (‘Affiliates’) will not be liable for any injury, damage or loss resulting from my attendance and participation in PolliePedal’26.
- I release the Diabetes Australia Group and its Affiliates from any claim and from any liability (to the maximum extent permitted by law) for, or as a result of, any loss, injury or damage suffered by me in relation to my participation in PolliePedal’26 however caused.
- I give permission for the Diabetes Australia Group to use my name, image, photographs, video and comments acquired during the event in any publications and marketing to report on or promote the event during PolliePedal’26 or in the future.
- Privacy Collection Notice. Diabetes Australia collects, stores and uses personal information in accordance with its Privacy Policy, available at https://www.diabetesaustralia.com.au/privacy-policy/.
